Part A — Using bighelpers.in and buying our services
A1. What Part A covers
These Terms of Service ("Terms") are an agreement between you and Bighelpers Software and Solutions Pvt Ltd, a company incorporated in India ("Bighelpers", "we", "us"). Our registered office is at HIG-2, M.P. Housing Board Colony, Tikuri, Katni 483501, Madhya Pradesh, India.
The Terms have two parts, plus shared rules at the end.
Part A covers the bighelpers.in website, our free tools and downloads, and the professional services you buy from us: web development, mobile apps, e-commerce, custom CRM, MVP development, AI chatbots, SEO work, fixed-price packages and maintenance retainers.
Part B covers the BusinessSetu Pro platform, our custom-CRM software for businesses.
Every project starts with a written scope of work (SOW) that you approve. The SOW says what we will build, what it costs, and when we deliver. If a project-specific detail in these Terms and your approved SOW ever disagree, the SOW prevails on that detail.
A2. Accepting these Terms
You accept these Terms when you use bighelpers.in, or when you pay an invoice or an advance for our services.
If you accept on behalf of a company or other organisation, you confirm that you have the authority to bind that organisation to these Terms.
A3. How payments work
The standard split. 50% advance to start, 30% when the milestone is delivered, 20% on launch. Larger projects can be split into 4 milestones instead. Your SOW shows which split applies to you.
Advances are held against work. Your advance is not kept as a separate fee. It pays for the work as we deliver it.
If a project stops mid-way. You only pay for the work already delivered.
Taxes. Prices are exclusive of applicable taxes. GST, if it applies, shows on your tax invoice. We email your tax invoice within 24 hours of a successful payment.
Gateway charges. Online payments carry payment-gateway charges of about 2.7% including GST. They are added at the payment step and shown to you before you pay.
How to pay. UPI, bank transfer, card or cheque. Online payments are processed by Razorpay, and Razorpay's own terms apply to them.
Delayed payments. Late payment attracts interest at 1.5% per month, or the maximum rate permitted by law, whichever is lower.
A4. Cancellation and refunds
Cancellations and refunds for services bought through bighelpers.in follow our Refund & Cancellation Policy. That page is incorporated into these Terms — read it as part of this document. In short:
If a project is abandoned mid-way, you pay only for the work delivered.
Approved refunds are issued to the original payment method within 7 business days of approval. Razorpay's own timelines apply after that.
BusinessSetu Pro subscriptions follow Section B7 — once charged, they are non-refundable except where the law requires it or your plan says otherwise.
A5. Maintenance retainers
Maintenance retainers are monthly. The retainer renews each month by invoice.
You can cancel any time with 7 days' notice before the next monthly renewal. There is no lock-in.
If you cancel, the month you have already paid for runs to its end, and the retainer stops renewing after that.
A6. Who owns what
You own the deliverables we build for you. On launch day, the source code, design files, hosting credentials and admin access for your project transfer to you.
We keep ownership of what was already ours: our pre-existing tools, code libraries and internal frameworks, and the platforms we run, including BusinessSetu Pro.
A7. Digital delivery only
We deliver services, not physical goods. We do not ship anything to your address. All work, files and access are delivered electronically or remotely, and your timelines are fixed in the written scope of work you approve.
A8. Rules for using this site
Bighelpers.in is open to everyone, so a few rules keep it working and safe. Do not:
submit or publish unlawful content through our site or forms
send spam or repeated fake enquiries through our contact forms or chat
probe, scan or test the vulnerability of our site without our written permission
scrape or copy the site in a way that harms, overloads or degrades the service
enter other people's sensitive data — such as card numbers, passwords or government IDs — into public forms that are not meant for them
We may block abusive traffic and remove unlawful submissions. To complain about content on our site, use the process on our Copyright page.
A9. Free tools and content
The free tools, templates and downloads on bighelpers.in are guides. They are not professional legal, tax or financial advice, and we give no warranty on their outputs. Use your judgement, and take professional advice for big decisions.
Our articles, guides, templates, tools and site content are protected by copyright and belong to us. The Copyright page explains what you may reuse and how to ask.
Part B — BusinessSetu Pro platform terms
Part B applies when you sign up for or use the BusinessSetu Pro platform. Signing up for an account or using the platform also means you accept these Terms. It adds to Part A and covers the platform only.
B1. Definitions
In Part B:
Service means BusinessSetu Pro, our software-as-a-service platform operated at businesssetupro.in, including any sub-path, sub-domain or companion app we run for it.
Customer means you: the person or business that subscribes to the Service.
Tenant means a Customer account within the Service that holds its own data, users and configuration.
End Customer means an individual or business with whom you transact and whose data you process through the Service.
Subscription means the plan you select with its associated fees, included quotas and term.
Content means any data, files, messages, templates, invoices, customer records or other material you upload, generate or transmit through the Service.
B2. Account and eligibility
You must be at least 18 years of age and capable of entering into a binding contract under Indian law.
You must provide accurate registration details and keep them current.
You are responsible for all activity that occurs under your account credentials.
You must notify us at admin@bighelpers.in immediately on any suspected unauthorised access.
B3. Licence to use the platform
Subject to your compliance with these Terms and timely payment of fees, we grant you a non-exclusive, non-transferable, revocable licence during the Subscription term to access and use the Service for your internal business purposes.
You may not sub-licence, resell, or expose the Service as a service to third parties without a separate written reseller agreement signed by us.
B4. Acceptable use
You agree not to use the Service to:
Send unsolicited commercial messages or spam through any channel
Distribute malware, phishing material, or any unlawful content
Infringe any third party's intellectual property, privacy, or other rights
Reverse-engineer, decompile, or attempt to derive source code from the Service
Probe, scan, or test the vulnerability of the Service without prior written permission
Interfere with other tenants' use of the Service or the underlying infrastructure
Process special-category personal data (financial account numbers, biometric data, health records) unless your plan explicitly permits it
B5. Your responsibilities as a tenant
BusinessSetu Pro is a multi-tenant SaaS. Each tenant operates its own slice of the platform and is responsible for:
Lawful collection of personal data from its End Customers, including opt-in consent for WhatsApp and SMS communications
Accuracy of invoices, GST identification numbers, HSN codes, and tax computations created through the Service
Compliance with the Shops and Establishments Act, GST Act, Income-tax Act, and any other applicable Indian law
Configuration of pickup addresses, courier preferences, payment instruments, and message templates
Communicating accurate delivery, refund, and grievance information to End Customers
Bighelpers acts as a platform provider only. We do not control the content you send, the goods you ship, the payments you collect, or the relationships you maintain with your End Customers.
You collect verifiable opt-in consent from each recipient before sending any non-transactional message and retain proof of that consent for at least 24 months.
You do not use the WhatsApp module for cold marketing, political messaging, or any category prohibited by Meta.
You honour stop, unsubscribe, and block requests within 24 hours.
You bear all per-message conversation charges levied by Meta, which we pass through to you at cost or a stated platform margin.
Repeated policy violation by your tenant may result in suspension by Meta, by us, or both. Meta's decisions on quality rating, throughput tier, and account status are binding on us and we cannot override them.
B7. Platform payments
Subscription fees are billed in advance for each term (monthly, quarterly, or annual) as shown in your plan.
Usage-based fees (WhatsApp conversations, SMS, courier surcharges, payment gateway commission) are billed in arrears each calendar month.
All fees are exclusive of GST. We issue a tax invoice for each charge.
Late payment attracts interest at 1.5% per month or the maximum rate permitted by law, whichever is lower.
Subscription fees, once charged, are non-refundable except where required by law or stated in your plan. Pro-rated refunds may be issued at our sole discretion for unused months of an annual plan terminated for our material breach.
Payments are processed by Razorpay Software Private Limited under Razorpay's own terms.
B8. Intellectual property in the platform
The Service, its source code, design, brand, and all related intellectual property remain the sole property of Bighelpers. Nothing in these Terms transfers ownership of the platform to you.
You retain all rights in your Content. By uploading Content you grant us a worldwide, royalty-free, non-exclusive licence to host, copy, transmit, and display that Content solely for the purpose of providing the Service to you.
B9. Data ownership and processing
Your Content is yours. We process it strictly as described in our Privacy Policy. Where you process personal data of End Customers through the Service, you are the Data Fiduciary and we are the Data Processor under the Digital Personal Data Protection Act, 2023. A separate Data Processing Addendum is available on request at admin@bighelpers.in.
B10. Service availability
We target a monthly uptime of 99.5 per cent for the Service, excluding scheduled maintenance announced at least 48 hours in advance and excluding events beyond our reasonable control. Service credits, if any, are described in the plan you select. Where no service credit is stated, this clause is a target and not a contractual guarantee.
B11. Suspension and termination
B11.1 By you
You may cancel your Subscription at any time from your account settings. Cancellation takes effect at the end of the then-current billing term.
B11.2 By us
We may suspend or terminate your access immediately on notice if:
Payment is overdue by more than 15 days
You breach Section B4 (Acceptable use), Section B6 (WhatsApp obligations), or any other material provision
We receive a lawful order from a court, regulator, or Meta
Your activity threatens the security or integrity of the Service or other tenants
B11.3 Data on termination
For 30 days after termination we make a one-time export of your Content available on request. After that period your Content is permanently deleted, subject to statutory retention obligations described in the Privacy Policy.
B12. Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that any defect will be corrected within a specific time.
B13. Limitation of liability
To the maximum extent permitted by applicable law:
Neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profit, revenue, business, data, or goodwill, even if advised of the possibility.
Our total aggregate liability for any claim arising under or in connection with these Terms is capped at the fees paid by you to us in the 12 months immediately preceding the event giving rise to the claim.
Nothing in this section limits liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be limited under Indian law.
B14. Indemnity
You agree to defend, indemnify, and hold harmless Bighelpers, its directors, employees, and agents from any third-party claim, damage, loss, or expense (including reasonable legal fees) arising out of:
Your Content or your use of the Service in violation of these Terms
Your violation of any applicable law, including the Digital Personal Data Protection Act, 2023, GST Act, TRAI regulations, or Meta's policies
Disputes between you and your End Customers regarding goods, services, payments, or deliveries
B15. Confidentiality
Each party will treat the other's non-public business information as confidential and will not disclose it to any third party except as required by law or to advisors bound by similar duties.
B16. Force majeure
Neither party is liable for failure or delay in performance caused by events beyond reasonable control, including acts of God, natural disaster, war, terrorism, civil disturbance, internet or telecom outage, action of a government authority, or pandemic.
Part C — Rules for everything
Part C applies to Part A and Part B together.
C1. Governing law and disputes
These Terms are governed by the laws of India. The courts at Katni, Madhya Pradesh have exclusive jurisdiction over any dispute, subject to a prior good-faith negotiation period of 30 days.
C2. Grievance Officer

We follow the complaint timelines on our Grievance page: we acknowledge a complaint within 48 hours and aim to resolve it within 30 days.
C3. Notices
Notices to us must be sent to admin@bighelpers.in. Notices to you may be sent to the email address linked to your account, or the one you gave us when you bought a service.
C4. Changes to these Terms
We may revise these Terms from time to time. We notify you of material changes at least 15 days in advance by email, and by a notice in the dashboard for platform users. If you keep using the site or the Service after a change takes effect, you accept the updated Terms. The "Last updated" date at the top of this page shows the current version.
C5. Entire agreement and general rules
Entire agreement. These Terms, together with our Privacy Policy, Refund & Cancellation Policy, your approved scope of work or plan, and any Data Processing Addendum we have signed with you (available on request at admin@bighelpers.in), form the entire agreement between you and us.
Assignment. You may not assign these Terms without our prior written consent. We may assign them to an affiliate or in connection with a corporate reorganisation.
Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
No waiver. Failure to enforce any right is not a waiver of that right.
